Terms & Conditions

1. Definitions

In these Terms & Conditions means myBROS Sdn Bhd, while 'MOVCOIN' is defined as the consumer rewards membership programme run by myBROS. 'Programme' refers to the MOVCOIN membership programme. 'Account' is defined as Member's Coins record. 'Travel Packages' are defined as the goods and/or services offered to Members in exchange for sufficient amount of Coins. 'Membership' means those arrangements by which a Member agrees to participate in the Programme and receives Coins by purchasing qualifying goods and services from Partners and so qualifies for Travel Packages under these Terms & Conditions. Reference to 'Partners' are to those companies (and other persons) who supply qualifying goods and services in respect of which Coins will be credited under the Programme. 'Suppliers' means Travel Packages provider or company/persons that are engaged by myBROS to supply the Travel Packages. 'Business Partners' are defined as Partners, Suppliers, service suppliers, contractors, vendors, agencies, agents or persons, which are appointed by myBROS for purposes of managing various aspects of the MOVCOIN Programme.


2. Membership

Membership of MOVCOIN is free. Any individuals may be Members. Any individual who wishes to become a Member must agree to be bound by these Terms & Conditions, as varied from time to time.

Members will provide information on a registration form (where information such as name, identification number, address, contact numbers, occupation, family particulars, customer preferences, as well as other similar personal information has been requested) or through other communication with myBROS, and when a Member uses the ID or give details to collect or redeem Coins, the Partner or Supplier in question will record in its database the details of the transaction on which those Coins are collected or redeemed. In certain instances, the Partner may send myBROS, their customer or subscriber information in order to register their subscriber on the MOVCOIN Programme as part of their Terms with the subscriber. If the Member transfers Coins from another Partner's loyalty scheme into MOVCOIN, associated information will also transfer to myBROS. Additionally, information about the Member may be obtained through various applications including the web or a poll/survey or by any other means that myBROS may introduce from time to time.


A Member must notify myBROS immediately of any change of address or details.

myBROS may terminate a Membership of MOVCOIN without notice and for any reason, including if the Member fails to comply with these Terms & Conditions:
  • Supplies any misleading information or makes any misrepresentations to myBROS or to any Partner in connection with MOVCOIN; or
  • Abuses any privilege accorded to the Member under the Programme; or
  • Engages in any fraudulent activities under the Programme; or
  • Does not use his/her Membership ID for a period of 6 months or more; or
  • Is deceased or is declared a bankrupt; or
  • Displays inappropriate behaviour against any member of myBROS staff

Termination of Membership will result in forfeiture of remaining Coins in a Member's Account. A Member may at any time terminate his or her Membership ID by giving notice to myBROS.

Coins can only be transferred from one Account to another Account upon the demise of a Member, to the next of kin or friend, with proper official documentation to be determined by myBROS from time to time being submitted. myBROS reserves the right to decline the transfer of Coins at our discretion without assigning any reason.

myBROS reserves the right to send Coins Summary Statement, catalogues or other promotional literature to a Member at its own discretion.

Any tax arising from a Member's participation in the Programme is the responsibility of the Member.



3. Collecting Coins

Coins will be recorded in a Member's Account, for purchases by the Member of qualifying goods or services from a Partner. Coins may also be recorded in a Member's Account in relation to promotional and incentive programs. myBROS and the Partners will from time to time determine which goods or services are qualifying goods and services and the number of Coins that will be recorded in a Member's Account for such purchases. myBROS and the Partners may from time to time offer exclusive promotions for specified groups of Members. Changes in Partners, the Coins issuance rate and the offers, may be made without prior notification to Members.


For a Member to be entitled to Coins, the following may apply: -
In the case where it is a subscription type service where Coins are calculated and issued back-end, the following may apply: -

a. The Member gives consent to a Partner to release personal and transaction information to myBROS, this may include the completion of a registration form to the Partner; or
b. The Member's Account is automatically linked to the Subscription through an IC number match and relevant information was provided to both parties. In such cases, it is the responsibility of the Member to ensure that identical data is provided to both myBROS and the Partner.


The Member may be introduced to other methods by which the Member may be able to receive Coins from the Partner and/or myBROS, which will be announced in their promotional literature from time to time.


Coins cannot be redeemed until credited to the MOVCOIN Account of the Member. Coins will be recorded in the Member's Account only after the Partner has notified myBROS of the details of the relevant transaction. These Coins may need to be recorded in the Member's Account on a daily, weekly, monthly, quarterly, annually or any other pre-determined interval depending on the frequency of notification from the respective Partners.


A Partner may operate a no refund policy for their qualifying goods or services. A Member who has collected Coins for such qualifying goods or services from Partners may not be eligible for any refund for the relevant transaction.


myBROS will from time to time forward a Coins Summary Statement to the Primary Member setting out the opening Coins balance, Coins recorded and deducted during the period and the closing Coins balance. However, myBROS reserves the right to withhold sending the Coins Summary Statement for the following reasons: -


a)When a Member does not use his/her ID for a period of time as determined by myBROS from time to time; or

b)When a Member does not accumulate a minimum number of MOVCOIN for a period of 12 months, which minimum shall be set by myBROS at its own discretion from time to time; or

c)When a Member's address is incorrect or incomplete; or

d)When myBROS encounters in its opinion, an abnormal transactions in a Member's Account

Disputes arising over the MOVCOIN Summary Statement must be notified to myBROS within one month from the date of the relevant Statement. Members are requested to provide supporting documents wherever applicable to assist myBROS settle the dispute. The Statement will otherwise be taken to be correct and binding on the Member. myBROS's decision on any such dispute is final and binding.


myBROS will not record MOVCOIN given by any company, nor entertain any dispute arising from a Partner after they have ceased to be a Partner in the Programme.

4. Redeeming Travel Packages

Only the Member with sufficient Coins is eligible to redeem, and he/she may do so using the various redemption methods implemented by myBROS. Redemption orders once accepted by myBROS cannot be revoked, cancelled, returned or exchanged, and the affected Coins will not be reinstated.

Members are strongly advised to adhere to safety precautions and instructions when participating in outdoor activities, as myBROS will not be held responsible for any outcome as a result of Members participation in the activity.

myBROS will make an arrangement with restaurant for member to redeem Travel Package on the spot within 2-4 weeks after Member is eligible to redeem the Travel Package chosen.

5. Reservation of Travel Packages

Members are allowed to reserve a Travel Package, which is temporarily out of stock, through the approved channels offered by myBROS. Once stock is available, the reservation will be processed as redemption subject to the Terms & Conditions of redemption, without prior notification to the Member. However any reservation that is not fulfilled after 1 month will be deemed as cancelled.

6. Deduction of Coins

The number of MOVCOIN published for a Travel Package claimed by a Member will be deducted from the Coins balance of the Member's Account. There is no expiry date to accumulate MOVCOIN.


myBROS may also deduct from the
MOVCOIN balance in a Member's Account, given the following circumstances: -

  • Any MOVCOIN suspected to be fraudulently recod; or
  • Any MOVCOIN recorded in error; or
  • Any MOVCOIN relating to a transaction which is cancelled
myBROS reserves the right to deduct any such MOVCOIN as stated above without notifying the Member.


7. Policy on Personal Data

myBROS and the MOVCOIN Programme respect the privacy of its Members. This is myBROS's policy on personal information collected through the Programme. It is part of the MOVCOIN Membership Terms & Conditions and Members are responsible for ensuring their Accounts, are aware of these Terms & Conditions.

Any of this information may be used by, and shared between myBROS and its Business Partners where necessary to operate the Programme in order to provide Members with services relating to the Programme, to communicate with Members, to status Members, to promote offers to Members, to fulfill Members' requests including redemption orders and for identification purposes. It is optional for a Member to provide the above information; however, if a Member chooses not to do so, myBROS may not be able to fulfill the services mentioned above. From time to time, myBROS may ask for additional information, to help improve its services to Members, to create more opportunities for Members to enjoy the Programme, to follow up with Members for feedback or to help prevent abuse of the Programme. Also, myBROS may automatically collect other information about Members indirectly through its database such as customer profile and consumer behavior. Any customer information (including Members name and contact details) and consumer behavior but excluding information that relate to specific goods or services that a Member buys, may be used by myBROS to analyze Members' activity on the Programme. myBROS may also use that information, and share it with the Business Partners in order to facilitate various services to the Members, to extend Member benefits and special offers, and for marketing purposes including planning, product development, telemarketing promotions, research and other carefully screened marketing programmes or activities, which myBROS and/or the Business Partners believe are likely to interest Members. Information regarding the specific goods or services a Member buys from a particular Partner will not be passed to myBROS or any other myBROS's Business Partners except where required to operate the Programme. Members can refer to the myBROS website at www.bros.com.my to view the list of Partners (which for these purposes include all companies in the same legal group).

Members shall ensure that all personal detail provided to myBROS is accurate at the point of submission and that myBROS is kept abreast and updated of any change in their personal details. If for any reason a Member believes that his or her personal information lodged with myBROS is inaccurate or if a Member would like to amend and reconfirm his or her personal information, they can contact myBROS via the following channels - email to MemberServices@mybros.com.my, or call the Member Services Centre at 03-89428987, or fax to 
03-89428987, or write to MOVCOIN Loyalty Sdn. Bhd. No.36A , Jalan PSK 8 , Pusat Perdagangan Seri Kembangan, 43300 Seri Kembangan, Selangor Darul Ehsan, Malaysia.

For as long as a Member remains in the Programme and maintains his/her Membership with MOVCOIN, their information will remain with myBROS. myBROS will take all practicable steps to ensure the security of the data at all times from any unauthorized access. myBROS will endeavor not to disclose any personally identifiable information to any organization unless necessary to operate the Programme and/or if myBROS is legally required to do so by law. Members will be treated as having given permission for disclosures referred to in this policy.



8. General

Membership Cards are not transferable and are the property of myBROS. Coins, and any rights they confer, cannot be sold, transferred, assigned or otherwise dealt with except in accordance with these Terms & Conditions. Coins have no cash or monetary value. myBROS may, at its absolute discretion, allow the transfer of Coins under certain exceptional circumstances.

myBROS may change, at any time and without prior notice, these Terms & Conditions, the Travel Package offers and/or the Partners. myBROS may make that change even if it has the effect of reducing or extinguishing the number or value of, or the period of expiry of, any existing or future Coins. myBROS will attempt to notify Members of any changes. myBROS may also change, at any time and without prior notice, the qualifying goods and services and/or the number of Coins, which Members will receive for purchasing such goods and services.

A notice shall be deemed to be given by myBROS to a Member if it is posted to the address of the Member appearing in the myBROS records or published in the media or on MOVCOIN website at www.mybros.com.my.

In the event where there is a discrepancy in communication to Members using the Bahasa Malaysia or Mandarin languages, the English version will prevail.

myBROS is not liable under the following circumstances:-
  • Any failure of a Member to notify a Partner that a transaction is a MOVCOIN transaction;
  • Any delay/failure of a Partner to notify myBROS of the details of a transaction;
  • Any unauthorized redemption of MOVCOIN;
  • Any unauthorized use of MOVCOIN or unauthorized sale of MOVCOIN;
  • Any loss, theft or damage to any Travel Package in the course of delivery;
  • Any Travel Package not being available for any reason;
  • Any failure by the Supplier to meet the Terms & Conditions to supply the Travel Package;
  • Any failure to notify Members of any changes in these Terms & Conditions, the Travel Package offered, Partners, qualifying goods and services and/or the number of Coins which will be recorded for the purchase of qualifying goods and services;
  • The suspension and/or termination of the Programme;
  • Any technical failure of system, including MOVCOIN's website, Self-Service Phone System and mobile short-messaging-service system which may impede a Member's transaction.
All conditions and warranties, whether express or implied and whether arising under legislation or otherwise, as to the condition, suitability, quality, fitness or safety of any goods or services supplied under the Programme are expressly excluded to the full extent permitted by law. Any liability myBROS may have to a Member under legislation in respect of such goods and services which cannot be excluded is limited, where permitted, to supplying, or paying the cost of supplying, the goods or services again or repairing, or paying the costs of repairing the goods, at myBROS's option. myBROS provides the Programme for Partners and Suppliers, and each exclusion or limitation of liability in these Terms & Conditions also applies to each of those companies, their employees and agents. myBROS's Business Partners do not have any authority, express or implied, to make any representation, warranty or statement on behalf of myBROS.

myBROS reserves the right to suspend or terminate the MOVCOIN Programme at any time without prior notice. myBROS reserves the right to assign or sell the Programme to another company whereby myBROS transfers all rights and obligations under these Membership terms without any further consent and may disclose or transfer all information held about Members to a prospective or actual new owner. Such a disclosure or transfer may not alter the rights of the Member in respect of the use that can be made of such information by such other company.
